Falls der Kreditnehmer nicht in der Lage ist, den erhaltenen Kredit zur\u00fcckzuzahlen, so hat der Gl\u00e4ubiger (in der Regel eine Bank) das Recht, die Zahlung dieser Geldsumme aus dem Grundst\u00fcck zu fordern. Das bedeutet auch, dass der Hypothekengeber Substanz und Nutzungen des Grundst\u00fccks \/ der Immobilie durch Zwangsvollstreckung nutzen darf, um die geforderte Geldsumme zu erhalten. Auch wenn der Kredit durch die Immobilie besichert ist, muss der Hypothekennehmer trotzdem Zinsen auf den erhaltenen Kredit bezahlen. Der Hypothekenzins richtet sich dabei in der Regel immer an das allgemeine Zinsniveau in dem jeweiligen Land.
